Perpetual Gold & Silver ("we," "us," "our," or "Company") operates the perpetualgoldandsilver.com website and online store. These Terms and Conditions ("Terms") govern your access to and use of our website, products, and services. Please read these Terms carefully before making any purchases or using our services. By accessing and using our website and purchasing from us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

Acceptance of Terms and Service Agreement

By accessing perpetualgoldandsilver.com and engaging with our services, you enter into a binding legal agreement with Perpetual Gold & Silver. This agreement is effective upon your first use of our website and continues as long as you use our services. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time, effective upon posting to our website. Your continued use of our website following any changes constitutes your acceptance of the modified Terms. We will make reasonable efforts to notify you of material changes, but it is your responsibility to review these Terms regularly. We recommend that you review these Terms each time you access our website to ensure you understand the current terms governing your use.

Products and Services

Product Descriptions and Availability

Perpetual Gold & Silver offers a curated selection of precious metals products, including bullion bars, numismatic coins, and other certified precious metals products. Product descriptions on our website are prepared with care to be as accurate as possible. However, we acknowledge that various factors may affect how products appear online, including variations in lighting, screen resolution, color calibration, and photography techniques. The actual color, finish, and appearance of a product may differ slightly from images shown on our website.

All products are subject to availability. While we strive to maintain accurate inventory information, stock levels can change rapidly due to market demand, customer orders, and acquisition of new inventory. If a product becomes unavailable after you place an order but before payment is processed, we will notify you immediately and offer alternatives or provide a full refund. We do not accept responsibility for out-of-stock conditions or for changes to product availability.

Pricing, Market Rates, and Price Locks

Precious metals are traded on global commodities markets that operate continuously, with prices fluctuating based on supply, demand, geopolitical factors, currency movements, and market sentiment. Because of these market dynamics, prices on our website are subject to change without notice. Prices displayed on our website represent our current quoted prices at that moment but are not guaranteed unless and until an order is confirmed and payment is received.

Pricing is valid only at the time of purchase. We reserve the right to correct any pricing errors that appear on our website, whether such errors are due to typographical mistakes, system errors, or other causes. If we identify a pricing error after you place an order, we will notify you immediately. If the error significantly affects the transaction, we may cancel the order and refund any payment received.

Precious metals pricing is directly tied to current market rates for the underlying metal content plus our professional markup, which covers acquisition costs, authentication, handling, storage, and customer service. When you place an order, the price is locked at the time payment is confirmed and processed. Orders that have been placed but not yet paid do not have price protection; if market prices change significantly before payment is received, we reserve the right to adjust pricing or cancel the pending order. Auto-invest program purchases are priced at the market rate on the date of the scheduled transaction, locked upon payment confirmation.

Product Authentication and Guarantees

All bullion and coins offered for sale through Perpetual Gold & Silver are guaranteed to be authentic precious metals products of the stated weight, purity, and type. This authentication guarantee is backed by our reputation and direct responsibility. We work exclusively with established, reputable suppliers and conduct rigorous inspection and verification of all products before they are offered for sale or delivered to customers.

If any product you receive is found to be counterfeit, artificially altered, or misrepresented in its specifications (weight, purity, or composition), you may return it within 30 days of receipt for a full replacement or refund at your option (this 30-day return window is separate from, and does not limit, the Lifetime Authenticity Guarantee described below). To initiate an authentication claim, you must contact our customer service team with photographic documentation and proof of purchase. We may request that you return the product for professional inspection. If authenticity is verified as an issue on our part, we will replace the product or refund the full purchase price without dispute or deduction.

Purchasing, Payment, and Order Process

How Orders Are Placed and Confirmed

All orders placed through our website constitute an offer to purchase precious metals from Perpetual Gold & Silver on the terms specified in these Terms and Conditions. We reserve the right to accept or refuse any order in our sole discretion. This right includes the ability to refuse orders from customers with whom we have had disputes, orders that appear fraudulent, or orders that violate applicable law or our policies.

Orders are not confirmed until payment has been received, processed, and verified by our payment processor. A payment authorization (hold) on your credit card does not constitute order confirmation. Order confirmation occurs only when funds have cleared and the transaction status shows as "completed" or "settled." You will receive a confirmation email when your order is officially confirmed, which will include your order number, itemized products, pricing, and expected delivery timeline.

If your payment is declined, fails, or is flagged as potentially fraudulent, we will attempt to contact you. We may place your order on hold pending resolution. If payment issues are not resolved within 72 hours, we reserve the right to cancel the order without further notice. Held orders do not have price locks; if you wish to complete the transaction after the hold period, we will quote you current market pricing.

Accepted Payment Methods and Security

Perpetual Gold & Silver accepts the following payment methods:

  • Credit and debit cards: Visa, Mastercard, and American Express (processed through our secure payment gateway)
  • Bank transfers: ACH transfers and wire transfers for large orders (please contact us for wire instructions)
  • Check payments: For orders exceeding certain thresholds (subject to approval)
  • Alternative payment methods: As announced on our website or communicated directly

All payment information is encrypted using industry-standard SSL/TLS encryption protocols during transmission to our payment processors. We never store complete credit card information, CVV codes, or full bank account details on our servers. Payment processing is handled by third-party payment processors certified to PCI DSS (Payment Card Industry Data Security Standard) Level 1, the highest security standard in the industry.

When you provide payment information, you authorize Perpetual Gold & Silver and our payment processors to charge the amount specified in your order. You are responsible for ensuring that the payment method you use is authorized to make the purchase and that all payment information is accurate. If a payment is made in error or without authorization, you must notify us immediately.

Order Processing and Payment Holds

Once payment is confirmed and cleared (typically 1-3 business days depending on payment method), your order enters our fulfillment queue. Large or custom orders may require additional processing time. We will notify you of any delays or issues that might affect your delivery timeline.

For wire transfers and bank transfers, order confirmation occurs only after funds have been received and cleared in our account, which may take 3-5 business days. During the clearing period, your order is held at the price confirmed at the time of transfer initiation, provided you include your order number in the transfer instructions.

Shipping, Delivery, and Risk of Loss

Shipping Methods and Logistics

Orders ship via insured courier services specializing in high-value shipments. We do not use standard shipping carriers for precious metals due to insurance and security requirements. All shipments are fully insured by our carriers against loss or damage during transit.

Available shipping methods include:

  • Standard insured shipping: 5-10 business days, included with most orders
  • Expedited insured shipping: 2-3 business days (additional fee applies)
  • International shipping: Available to select countries with additional customs and insurance fees

Shipping costs are calculated and displayed at checkout based on order weight, destination, and chosen shipping method. Shipping costs are non-refundable once an order ships. International orders are subject to customs duties, import taxes, and VAT which are the responsibility of the recipient and are not included in our quoted shipping prices.

Delivery Timeline and Delays

Estimated delivery timeframes (5-10 business days standard, 2-3 business days expedited) are provided as estimates only and are not guaranteed. Actual delivery times may vary due to factors beyond our control, including weather events, carrier delays, customs processing for international shipments, holidays, and other unforeseen circumstances. We are not responsible for delays caused by carrier issues, weather, natural disasters, customs delays, or other force majeure events.

Once your order ships, you will receive a tracking number via email. You are responsible for tracking your shipment and being available to receive delivery. If a delivery attempt is made and no one is available to receive the package, the carrier may return it to us. We will not be liable for delays caused by failed delivery attempts.

Risk of Loss and Insurance

Risk of loss transfers to you upon delivery confirmation by the carrier. This means that once the package is delivered to your address (as confirmed by the carrier), you assume all risk of loss, theft, or damage. We recommend signing for delivery and inspecting the package immediately upon receipt to ensure it arrives in good condition.

All shipments are insured against loss or damage during transit. However, insurance claims require prompt reporting and documentation. If you receive a package that is damaged, appears to have been tampered with, or is missing contents, you must:

  1. Document the damage: Take clear photographs of the package exterior and interior contents
  2. File a claim promptly: Contact us within 24 hours of delivery with documentation
  3. Preserve the package: Do not discard packaging or the carrier labels, as these are needed for the insurance claim
  4. Cooperate with investigation: Insurance carriers may require additional evidence or inspection

Claims must be filed within 30 days of delivery. Claims filed after 30 days may be denied by the insurance carrier. We will work with the carrier on your behalf, but you must provide the supporting documentation.

Storage Services and Allocated Accounts

Storage Options and Account Types

Perpetual Gold & Silver offers several storage account types to meet different client needs:

Non-Allocated Storage: Your precious metals are pooled with other clients' metals of the same type and purity. You own a specific weight of gold, silver, platinum, or palladium, but not specific individual bars or coins. Non-allocated storage offers lower fees due to operational efficiencies. Your holdings are segregated from our operating capital and are held in trust exclusively for clients.

Segregated Storage: Your precious metals are stored separately from other clients' holdings and are not commingled. Each account is clearly identified with your name, account number, and specific inventory. Segregated storage provides additional assurance of ownership separation, though it may have higher associated fees.

Account Management: Upon opening a storage account, you receive an account statement showing your holdings by metal type, weight, and purity. Statements are provided quarterly or upon request. You may request withdrawal or sale of your stored metals at any time, subject to market conditions and processing fees.

Storage Fees and Pricing

Storage fees are charged either annually or monthly, depending on your account type and the amount of precious metals stored. Fee structures are based on:

  • Type and amount of metal stored: Gold, silver, platinum, and palladium may have different fee rates based on storage space, insurance costs, and market norms
  • Account type: Allocated, non-allocated, and segregated storage may have different fee schedules
  • Facility used: Fees vary based on the security level and location of storage facilities

Current fee schedules are available upon request and will be provided when you open an account. Fees are deducted annually or monthly from your account as specified in your storage agreement. Fees are non-refundable once charged, as they represent actual storage, insurance, and security costs incurred.

If you close your storage account or withdraw metals, any unused portion of prepaid fees will be refunded on a pro-rata basis. If your account is in arrears (unpaid storage fees), we may sell a portion of your holdings to cover the outstanding balance, provided we give you 30 days written notice of the overdue amount.

Storage Facility Security and Insurance

All precious metals held in storage are maintained in secure, insured facilities that meet or exceed industry standards for high-value asset storage. Our facilities include:

  • 24/7 armed security: Trained security personnel with access controls and surveillance
  • Vault-grade construction: Fire-rated, theft-resistant vaults with multiple redundant locks and access controls
  • Regular inspections: Third-party security audits and facility inspections performed quarterly
  • Comprehensive insurance: Coverage from A-rated insurance carriers for loss, theft, or damage

You will receive documentation of the insurance coverage for your account. Storage facilities are regularly audited by independent auditors to verify inventory accuracy and security procedures.

Inventory Audits and Verification

All stored precious metals are subject to periodic physical audits to verify inventory accuracy and ensure proper storage procedures are being followed. Clients will be notified in advance of scheduled audits. Audits are typically conducted quarterly, with results provided to account holders.

During audits, we may restrict access to specific holdings while inventory is being counted and verified. Any discrepancies discovered during an audit are investigated immediately and reported to the affected account holder. If a shortage is discovered due to our negligence or error, we will replace the missing metals or provide compensation at current market value.

Returns, Refunds, and Buyback Program

Return Policy and Conditions

Precious metals products purchased from Perpetual Gold & Silver may be returned for refund under the following conditions:

Return Window: Products must be returned within 14 days of delivery. Returns requested after 14 days will not be accepted.

Condition Requirements: Returned products must be in original condition with all original packaging, documentation, and certification intact. Products must not show signs of cleaning, artificial treatment, or damage beyond normal handling. If a product shows signs of alteration or damage beyond our control, it may be rejected or subject to a reduced refund.

Return Process:

  1. Contact our customer service team to initiate a return
  2. Obtain a return authorization number (RMA)
  3. Ship the product back to us via insured courier (return shipping is the customer's responsibility)
  4. We will inspect and verify the product upon receipt
  5. If the product meets return conditions, you will receive a refund or exchange as requested

Non-Returnable Items:

  • Custom orders or specially commissioned products
  • Products damaged due to customer mishandling or negligence
  • Items without original packaging or authentication documentation
  • Products that have been cleaned, altered, or artificially treated
  • Coins or bullion that have been removed from original storage and exposed to environmental damage

Refund Processing: Refunds are processed within 5-10 business days of receiving and inspecting the returned product. Refunds are issued to the original payment method. Refunds do not include original shipping costs or return shipping costs paid by the customer.

Buyback and Exchange Program

Perpetual Gold & Silver offers a buyback program for precious metals customers. We will purchase precious metals directly from you based on current market prices. Buyback prices are typically quoted at the current spot price of the underlying metal minus a professional buyback spread (typically 1-3% depending on the product and current market conditions). The buyback spread compensates for our acquisition costs, verification, and inventory management.

To obtain a buyback quote:

  1. Contact our customer service team with details of the precious metals you wish to sell
  2. Provide photographs and weight/purity documentation if available
  3. We will provide a non-binding quote based on current market prices and product condition
  4. Once you accept the quote, we will arrange for shipment of the precious metals to us
  5. Upon receipt and verification of the metals, payment will be processed within 3-5 business days

Buyback quotes are valid for 24 hours from the time of quote. After 24 hours, we will provide an updated quote based on current market prices, as precious metals prices may change significantly. For bullion refunds, a buyback spread may be applied in addition to any restocking or condition-related adjustments.

Auto-Invest Program

Coming soon — not yet available. The Auto-Invest program is currently under development and is not yet offered. The terms below describe how the program will operate once launched and will take effect only when the program becomes available. Until then, no Auto-Invest enrollments, authorizations, or recurring charges occur.

Program Overview and Benefits

Once launched, Perpetual Gold & Silver will offer an Auto-Invest program for clients who wish to establish a systematic, recurring purchase of precious metals. The Auto-Invest program allows you to schedule regular purchases at a frequency of your choosing (monthly, quarterly, bi-annually, or annually), enabling a disciplined investment approach often referred to as "dollar-cost averaging" in precious metals.

The Auto-Invest program is designed for long-term investors who commit to regular purchases over an extended period. By investing regularly regardless of price fluctuations, you can reduce the impact of short-term market volatility and build a diversified precious metals portfolio over time.

Setup, Authorization, and Modifications

To establish an Auto-Invest account, you must provide written authorization for recurring charges to your designated payment method. Written authorization may be provided by:

  • Completing an Auto-Invest authorization form on our website
  • Sending a signed authorization form via email or postal mail
  • Providing verbal authorization recorded by our customer service team

You retain full control over your Auto-Invest account. You may:

  • Modify payment amount: Change the dollar amount invested in each recurring purchase
  • Change investment schedule: Adjust the frequency of purchases (e.g., from monthly to quarterly)
  • Switch metals: Change which precious metals or specific products are purchased
  • Pause or cancel: Temporarily suspend or permanently cancel the program with written notice

Modifications to your Auto-Invest program must be submitted in writing at least 5 business days before the next scheduled transaction to ensure the changes take effect as requested.

Pricing and Payment Authorization

Auto-Invest purchases are priced at the market rate on the date of the scheduled transaction. Each month (or on your scheduled date), the current market price will be quoted, and your account will be charged based on that current pricing. This means the number of ounces or coins you receive may vary from month to month depending on market prices, but your dollar amount invested remains consistent.

Pricing is locked upon payment confirmation for each individual transaction. You authorize Perpetual Gold & Silver to charge your designated payment method on the scheduled date each period. If a payment is declined, fails, or is flagged as fraud, we will attempt to retry the charge. If payment fails after multiple attempts, we will notify you and may suspend the Auto-Invest program until payment is resolved.

Cancellation and Program Changes

You may cancel your Auto-Invest program at any time by submitting a written cancellation request. Cancellations must be received at least 5 business days before your next scheduled transaction to prevent that charge from occurring. Cancellations submitted after this deadline will take effect on the following scheduled payment date.

There are no cancellation fees or penalties for discontinuing the Auto-Invest program. All purchases made prior to cancellation remain final and non-returnable (subject to the standard return policy for new purchases).

Product Warranty and Authentication Guarantee

Lifetime Authenticity Guarantee

All bullion bars, coins, and precious metals products sold by Perpetual Gold & Silver carry our lifetime authenticity guarantee. We warrant that all products sold are genuine precious metals of the stated composition, weight, and purity, and are not counterfeit, artificially altered, or misrepresented in any material respect.

This warranty is provided exclusively to the original purchaser from us and is non-transferable to subsequent owners or resellers. The warranty does not cover normal wear and tear, toning, oxidation, or changes in appearance that naturally occur to precious metals over time.

Warranty Coverage and Exclusions

The authenticity warranty covers:

  • Metal composition and type (genuine gold, silver, platinum, palladium, etc.)
  • Weight accuracy (products weigh what they are stated to weigh)
  • Purity and fineness (products meet stated purity standards such as .999, .9999, or other designations)
  • Absence of counterfeiting or artificial alteration

The warranty does NOT cover:

  • Normal wear, toning, or oxidation that occurs naturally over time
  • Damage from improper cleaning, storage, or handling
  • Changes in value or desirability of the product
  • Unauthorized alteration, repair, or modification of the product
  • Products purchased from unauthorized resellers (our warranty applies only to direct purchases from Perpetual Gold & Silver)

Filing a Warranty Claim

To file an authenticity warranty claim:

  1. Contact Us Promptly: Reach out to our customer service team as soon as you suspect an authenticity issue. Provide your proof of purchase and order details.
  1. Document the Issue: Provide clear photographs of the product showing any visible defects, unusual markings, weight discrepancies, or other concerns. Include photographs of the original packaging and authentication documents.
  1. Return the Product: We will provide return instructions. You must return the product in its original condition for inspection. Return shipping costs may be covered by us if authenticity is verified as our error.
  1. Professional Inspection: Upon receipt, we will have the product professionally inspected by precious metals assayers and authentication specialists to verify whether an authenticity issue exists.
  1. Resolution: If authenticity is confirmed as an issue on our part, we will provide:
  • A replacement product of equivalent value and type, OR
  • A full refund of the original purchase price, OR
  • A store credit of equivalent value

Your choice of resolution will be honored.

Limitation of Liability and Risk Acknowledgment

As-Is Disclaimer

Except as expressly warranted in these Terms and Conditions (specifically the authenticity guarantee and storage security commitments), all products are sold "as-is" without any other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • Products will increase in value or serve as a profitable investment
  • Products will retain resale value or be easily resold
  • Products will be free from all imperfections, spotting, or color variations consistent with natural precious metals
  • Products will meet any specific investment objectives or goals you may have

Liability Cap and Damages Exclusion

Our Total Liability: Our total liability to you for any claim, whether based on warranty breach, negligence, contract breach, or any other legal theory, shall not exceed the original purchase price of the specific product that is the subject of the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including:

  • Lost profits or lost business opportunities
  • Diminished investment value or market losses
  • Costs of cover or substitute products
  • Business interruption or loss of use
  • Emotional distress or reputational harm

Precious Metals Investment Risk

Precious metals are commodity investments subject to significant price fluctuations driven by:

  • Global supply and demand dynamics
  • Currency exchange rates and inflation
  • Geopolitical events and market sentiment
  • Interest rate changes and economic data
  • Central bank policies and actions

Past Performance: Historical price movements and returns do not guarantee or indicate future results. Precious metals may increase or decrease in value substantially. You acknowledge that investing in precious metals carries the risk of financial loss and that your investment may be worth less than your initial purchase price.

No Financial Advice: Perpetual Gold & Silver does not provide investment advice or financial guidance. Product information provided on our website or by our staff is educational only and should not be construed as a recommendation to buy, hold, or sell precious metals. You should conduct your own research and consult with a qualified financial advisor before making investment decisions.
